CIAA investigating private sector entrepreneurs’ business, what are the preparations?

Kathmandu. The Commission for the Investigation of Abuse of Authority (CIAA) is preparing to investigate into the transactions of private sector entrepreneurs. The CIAA is also preparing to investigate business transactions with the objective of ensuring good governance in every activities of the private sector.

According to the Second National Strategic Plan Against Corruption (2082/832087/88), the corrupt activities in all sectors will be criminalized and Loss Loss or given undue advantage to the State. Except , the policy and legal system will be improved to provide an opportunity to correct the ( misdemeanor }. For this, the CIAA has planned to make necessary arrangements to eliminate corruption in the cooperative sector, public or private company or any other private organization and institution. 

According to the strategy, a new Prevention of Corruption Act will be formulated within 2 years to define corruption in the cooperative sector and public or private companies or any other private organization, corruption offenses and punishments, misappropriation or lossof private sector property, investigation, investigation and prosecution agencies and prosecution bodies. 

Similarly, the CIAA has also put forward a plan to amend the Civil Procedure Code, 2074 and other acts and regulations related to the private sector as per the time- to discourage all types of irregularities or corruption in the company,partnership firms, other private organizations and cooperative sector. 

The government has put forward a plan to punish the act of taking bribes in the economic, financial or business activities of the private sector. For this, the CIAA is preparing to make provisions in the new Act to punish the act of taking bribe and to amend the existing laws related to the private sector accordingly.

The CIAA has planned to make legal provisions to control corruption activities by the private sector in such a way as to misappropriate government or public property or damage to public property .The CIAA is preparing to make a new legal provision to provide additional punishment to the government or public loss within 2 years. 

The Authority in its strategic plan shall enact a law within 2 years to punish the acts of the cooperative sector and the public or a company or any other private association, organization, altering the records of income and expenditure / or not showing expenses or using a wrong instrument or intentionally destroying the records It has announced its plans. 

In order to make the purchase and sale ofshares by the private sector regular, transparent and systematic, the company directive shall be issued by the buyer to submit the original bank statement of the amount deposited in the seller’s bank account along with the voucher or cheque of the same.To amend 2072 BS, to develop a code of conduct, directives or standards or procedures to maintain purity in the activities of the private organizations and to maintain purity in the activities of the private organizations, to increase transparency by strengthening the internal audit and control of private organizations, to investigate whether the transactions of private sector entrepreneurs involved in public procurement activities have been carried out in accordance with the prevailing laws, The anti-graft body has put forth plans to conduct investigations, monitor the accounts of the private sector and monitor whether the established standards of auditing are followed and legal provisions to punish those who fail.
