Writ petition filed at Supreme Court challenging Constitutional Council’s decision on recommendation of Chief Justice

Kathmandu. A writ petition has been filed at the Supreme Court challenging the decision of the Constitutional Council to recommend the Chief Justice. Senior advocate Dinesh Tripathi and advocate Prem Raj Silwal had filed a writ petition at the apex court on Friday. 

The fourth judge in the post of Chief Justice Dr.A writ petition has been filed at the Supreme Court arguing that the recommendation of Manoj Kumar Sharma is against the principle of separation of power ( of the constitution. 

This practice will destroy the independent judiciary. In the petition, Dr. They have also demanded that the decision of the Constitutional Council to recommend Manoj Kumar Sharma as the Chief Justice should be annulled. 

Likewise, the petitioner has demanded that Acting Chief Justice Sapana Pradhan Malla be recommended in place of Sharma.However, the writ petition has not been filed. Chairman of the National Assembly Narayan Prasad Dahal and leader of the opposition Bhishma Raj Angdembe have written a note of dissent on the decision of the Constitutional Council.
