The court has awarded compensation to the victims after it was proved that Berger had sold substandard goods in 7 months saying that it would last for 7 years. Dayaram Karki had purchased paints worth Rs 1,45,894, Deepak Raj Giri Rs 1,19,941 and Shrestha Rs 3,45,841. However, after the paint that was supposed to last for 7 years did not last even 7 months, Karki and Giri went to court claiming that the company should do it, according to the Consumer Protection Act, 2075. Finally, the court awarded Rs 3,46,100 to Giri, Rs 6,34,800 to Shrestha and Rs 2,97,500 to Karki. A division bench of Justices Gehendra Raj Regmi and Ananda Raj Pokhrel issued the verdict.
The court not only asked the Berger to compensate the poor paint sellers, but also found that the advertisement being done by the company was wrong. The court said that the brand ‘Weathercoat Long Life: Exterior Emulsion with PU’ was advertised through the media as ‘Repels Heavy Rain, Guarantee of 10 Years’. Not only this, the company had written a strange condition in the warranty certificate that only those who buy more than 40 liters of color should be given. The warranty should also be in one liter.
